UPDATE:

The trustee reports that the settlement funds are still being held because of a dispute with the IRS. She hopes to resolve that issue soon and finally release funds in March.

January 8, 2014-Statement from the Trustee:

“While the trustee was hopeful that payments to victims of My US Legal Services and US Loan Auditors would be mailed by the end of December that is not yet possible now. The IRS has made an erroneous assessment of over $146,000, and while the IRS as admitted the assessment is a mistake, they have not yet provided the trustee with a written withdrawal. Until the trustee has a written withdrawal of the assessment she cannot disburse payments to anyone, including herself. The trustee has been pushing, and will continue to push, the IRS to provide the written withdrawal but cannot currently estimate when disbursements will be made. The trustee apologizes for this delay but it is out of her control.”


UPDATE:

Due to the federal government shutdown, the Trustee was unable to file her petitions with the U.S. Trustee's Office earlier this month. She has now done so. This delay may impact the mailing date for checks. It typically takes up to three months to process such a request. The Trustee is requesting that the process be expedited. We will update this notice when we have more certain dates.


After a diligent search of over 350 boxes of client files, all client files in the Trustee's possession have been returned to former clients of My US Legal Services and US Loan Auditors who timely-returned, completed Client File notices. Former clients may have provided documents to My US Legal Services and US Loan Auditors that were not in any of the boxes in the Trustee's possession and the Trustee can only return what is in her possession. All remaining client files and business records of My US Legal Services and US Loan Auditors will be destroyed. Payments on account of allowed claims should in the mail by the end of December 2013.

Client files that are being returned to former clients of My US Legal Services and US Loan Auditors are being mailed between August 16 and 31, 2013 to those who timely returned, completed Client File notices. The trustee is inspecting every box in order to return the client files. Whatever client files exist are what will be returned. There may be documents that former clients provided to My US Legal Services and US Loan Auditors that are not in any of the boxes in the trustee's possession and she can only return what is in her possession.

Payments on account of allowed claims should be in the mail by the end of December 2013.

The purpose of this website is to provide information to potential Settlement Class Members about the proposed Settlement with US Loan Auditors, and to inform Settlement Class Members of
1) the certification of the Settlement Class,
2) the terms of the proposed Settlement,
3) their right to file a claim form
4) their right to exclude themselves ("Opt-Out") from the Settlement Class,
5) their right to object to the Settlement, and
6) the hearing at which time the Court will determine whether to grant final approval of the proposed Settlement.
